Important Membership Notice

By submitting an enrolment or booking with Takapuna Learning Club (TLC), you confirm that you have read, understood, and agreed to this Membership Policy, the Terms & Conditions, and the Privacy Policy.

In particular, you acknowledge and agree that:

a. You understand and accept the cancellation, credit, and non-refund policies outlined in this Membership Policy and the TLC Terms & Conditions; b. You agree to payment of applicable membership, weekly pass, or tutoring fees as set out at the time of enrolment; c. You understand that TLC may restrict, suspend, or terminate a membership in accordance with this policy.

1. Definitions

For the purposes of this Membership Policy:

Application Form — Means the enrolment form completed online, electronically, or in person by or on behalf of the Member, including all required student, parent/guardian, and billing details.

Billing Account — Means the bank account, credit card, or payment method nominated for fee payments.

Member — Means the enrolled student and includes the parent or legal guardian where the student is under 18 years of age.

Membership — Means participation in TLC programmes, including weekly passes, tutoring sessions, and related services.

Membership Fees — Means all fees payable for Weekly Passes, 1-on-1 tutoring sessions, or other TLC programmes.

TLC / Takapuna Learning Club — Means Takapuna Learning Club operated by Motion Cinema Limited, including its staff, contractors, and representatives.

You / Your — Means the parent or legal guardian listed on the Application Form.

2. Application of This Policy

2.1 This Membership Policy, together with TLC's Terms & Conditions and Privacy Policy, forms a legally binding agreement between TLC and the Member.

2.2 Membership is confirmed when an Application Form is submitted and payment is received.

2.3 By enrolling, you confirm that you have not relied on any verbal or informal representations outside of these documents.

3. Membership Commencement & Access

3.1 Membership commences on the date of enrolment or the first booked session, whichever occurs first.

3.2 Membership access is limited to the specific programme booked (e.g. Weekly Pass or 1-on-1 tutoring).

3.3 Memberships are not transferable unless approved in writing by TLC.

4. Fees & Payments

4.1 All Membership Fees must be paid in advance unless otherwise agreed in writing.

4.2 TLC operates as a cashless business and accepts electronic payment methods only.

4.3 Failure to maintain up-to-date payment details may result in suspension of bookings or membership access.

4.4 TLC reserves the right to recover reasonable costs associated with failed or dishonoured payments.

5. Weekly Pass Memberships

5.1 Weekly Passes are non-refundable once booked.

5.2 Weekly Passes may be credited to another week if TLC is notified before or during the booked week.

5.3 Credits are subject to availability and must be used within the same term unless otherwise approved.

6. 1-on-1 Tutoring Memberships

6.1 Cancellations made more than 24 hours before the scheduled session may be refunded or rescheduled.

6.2 Cancellations made within 24 hours of the session start time are non-refundable.

6.3 Missed sessions without notice are forfeited.

6.4 Rescheduling within 24 hours is at TLC's discretion.

7. Cooling-Off Period

7.1 New memberships are subject to a 14-day cooling-off period, starting from the enrolment date.

7.2 Requests to cancel during the cooling-off period must be made in writing.

7.3 Refunds during this period will be pro-rated, less any sessions attended and reasonable administrative costs.

8. Cancellation Policy

8.1 This section sets out the cancellation notice requirements for TLC services.

8.2 Lesson Cancellations (1-on-1 Tutoring)

   a. Members must provide a minimum of 24 hours' notice to cancel or reschedule a booked     lesson.

   b. Cancellations received with more than 24 hours' notice will be eligible for a refund or reschedule.

   c. Cancellations received within 24 hours of the session start time will be forfeited without refund.

   d. Repeated late cancellations may result in restricted booking access at TLC's discretion.

8.3 Membership Cancellations

   a. Members must provide a minimum of 14 days' written notice to cancel their membership.

   b. Notice must be submitted in writing to TLC (email is acceptable).

   c. Membership access and any associated billing will continue during the 14-day notice period.

   d. Fees paid in advance beyond the notice period will be refunded on a pro-rated basis, less any sessions attended and reasonable administrative costs.

   e. Memberships cannot be cancelled during a freeze period (see Section 9).

8.4 How to Submit a Cancellation All cancellation requests must be submitted in writing. TLC will acknowledge receipt within two (2) business days. Verbal cancellations will not be accepted.

9. Membership Freeze

9.1 Members may request a temporary membership freeze of up to four (4) weeks per year.

9.2 Freeze requests must be submitted with at least one (1) week's notice.

9.3 Memberships cannot be cancelled during a freeze period.

9.4 Fees during a freeze will be credited at TLC's discretion.

10. Class Bookings & Attendance

10.1 All sessions must be booked in advance.

10.2 Class spaces are limited and allocated on a first-come basis.

10.3 Repeated non-attendance or late cancellations may result in restricted booking access.

​

11. Behaviour & Conduct

11.1 Members must behave respectfully toward staff, peers, and property.

11.2 Bullying, unsafe behaviour, or repeated disruption will not be tolerated.

11.3 TLC may suspend or terminate membership due to behavioural concerns.

11.4 No refunds are provided for termination due to behaviour.

12. CCTV Surveillance

12.1 CCTV operates on TLC premises for safety and security.

12.2 By enrolling, you consent to CCTV recording in accordance with TLC's Privacy Policy.

13. Property & Damage

13.1 TLC is not responsible for lost, stolen, or damaged personal belongings.

13.2 Parents/guardians are liable for intentional damage caused by their child.

​

14. Termination of Membership

14.1 Membership may be cancelled with 14 days' written notice, except during freeze periods (see Section 9).

14.2 Immediate cancellation may be approved in cases of permanent illness or incapacity with medical evidence.

14.3 TLC may immediately suspend or terminate membership if:

  • Fees remain unpaid

  • Terms are breached

  • Behaviour poses safety concerns

  • TLC operations cease without a suitable alternative

15. Intellectual Property

15.1 All worksheets, lesson plans, tutoring strategies, and learning materials are the intellectual property of Takapuna Learning Club.

15.2 Materials are for personal educational use only while enrolled.

15.3 Materials must not be copied, shared, or used for private or commercial tutoring without written permission from TLC.

16. Privacy & Personal Information

16.1 TLC collects and uses personal information in accordance with the Privacy Act 2020 and TLC's Privacy Policy.

16.2 Information is used only for programme delivery, safety, communication, and administration.

16.3 You consent to the collection, use, and disclosure of personal information as outlined in these documents.

17. Media & Promotion

17.1 TLC may take photos or videos during sessions.

17.2 Parents may opt out of promotional use in writing.

17.3 TLC retains ownership of all media content created.

​

18. Governing Law

18.1 This Membership Policy is governed by the laws of New Zealand.

18.2 Any disputes will be subject to the jurisdiction of New Zealand courts.

​

19. Changes to This Policy

19.1 TLC may update this Membership Policy from time to time.

19.2 Continued participation constitutes acceptance of updated terms.
